MOPolitics Libel Watch: Day 1

Our buddy Johncom posted that John Hancock's new blog will set a new standard because it "will identify the authors of all news, opinion, and gossip content on the site". This will supposedly ensure that the site will stay libel free. Now, first, one would have to note just how hard it is to prove that a statement can be considered libelous or generally defamatory. Due to our the First Amendment, there is massive latitude in this area, particularly in political speech. One has to prove that there has been "actual malice" or reckless disregard for the truth or a knowledge of falsity. More critically, satire and humor have plenty of wiggle room as well, so I can in jest say "John Hancock hates children and kills puppies" without fear of prosecution. This right, as well as most postings on the internet, including annon. ones on message boards, is preserved in part to prevent there from being a chilling effect on free speech. Basically, the charges of libel are bullshit. I challenge any blogger, Mr. Hancock, any and all comers, to show me anything that could stand as a libelous claim in a court of law that has been posted on FiredUp or any of the other Dem Blogs for that matter.

Just to give him the benefit of the doubt, that maybe he has come clean, we're going to start MOPolitics Libel watch. If you catch anything libelous, or potentially libelous that you think is notable from our new friends in the blogosphere (once it's up and running, send it here. Be careful.
